Supreme Court: Agnipath scheme is valid and not arbitrary

The Supreme Court upheld the legitimacy of the Agnipath plan by ruling that public interests outweigh other factors.

On Monday, the Supreme Court rejected two appeals and upheld the Center’s Agnipath plan, ruling that it is lawful and not arbitrarily applied. According to the Supreme Court, public interests take precedence over all other factors. Before the implementation of the Agnipath plan, candidates who were chosen in the defense recruitment procedure did not have a vested right to appointment, according to the Supreme Court.

The Agnipath plan, which had been the subject of two petitions to the Supreme Court, was maintained by the Delhi High Court in February. The Agnipath initiative was developed in the national interest and to ensure that the armed forces are properly equipped, according to the Delhi High Court’s judgment.

We regret that we are unable to support the high court’s decision. The high court had addressed every issue, the court stated in dismissing separate appeals brought by Gopal Krishan and lawyer ML Sharma challenging the high court’s decision.

However, the bench scheduled a hearing for April 17 on a third new petition regarding recruitment into the Indian Air Force (IAF) before the introduction of the Agnipath plan.
